Eftpos Gift Card Terms & Conditions

In these terms and conditions of use (Terms) 'you' are the purchaser or user of the stored value eftpos debit card (Card) issued by Emerchants Payment Solutions Limited ABN 30 131 436 532, AFSL 404131, and distributed by Edge Loyalty Systems Pty Ltd ABN 96 138 299 288 (We/us/our).

If you purchase, use or attempt to use your Card you accept and agree to be bound by these Terms.

  1. You must give these Terms to any user of the Card if that is not you. The Card remains our property.

  2. The issue date of your Card is the date of delivery of the qualifying product which entitled you to receive the Card (Issue Date). The Card must be activated within 3 months of the Issue Date (Activation Period). To activate the Card you must go online to www.activatemyCard.com.au/hnactivate and enter in the required details. Once activated, funds are available for use on the Card by 12pm the following business day. The Card is valid for 12 months from the Issue Date (Redemption Period) and can be used for purchasing goods and services wherever eftpos prepaid cards are accepted for electronic transactions during the Redemption Period. After such time it will be invalid. The Card is not a credit card and is not linked to a deposit account with us. Please be aware some merchants may choose not to accept eftpos prepaid gift cards.

  3. The Card cannot be used to make transactions that exceed the available balance. If you wish to make a purchase for an amount that exceeds the remaining Card value, you must pay the excess using another payment method.

  4. The Card is not reloadable. To check the Card balance, Card expiry and full conditions of use, go to www.activatemyCard.com.au/hnactivate.

  5. Cards cannot be used to purchase gift cards.

  6. If the Card has not been activated within the Activation Period, any and all balances will be forfeited. No refunds, credits or exchanges permitted. We will not give you any notice before this happens.

  7. The Card cannot be used after expiry of the Redemption Period. At expiry, the remaining available balance will be forfeited. No refunds, credits or exchanges permitted. We will not give you any notice before this happens.

  8. The Card cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular instalment payments. Your Card may only be used at retailers and merchants who accept the Card. Authorisations may be declined at some merchants (such as gambling merchants or merchants who choose not to accept prepaid cards). We are not liable in any way when an authorisation is declined for any particular transaction except where the authorisation has been declined because of an act or omission on our part.

  9. The Card is like cash therefore keep it secure. Anyone holding the Card can use its value to make purchases. You are liable for all transactions on your Card, except to the extent to which there has been fraud or negligence by us. If your Card is lost or stolen, or you suspect an unauthorised transaction, you should contact our Client Services team immediately on 1300 079 267 during business hours or by email to info@giftCardplanet.com.au. We may be able to stop Card value being used, but require the Card number, original balance and Issue Date.

  10. We may replace a faulty Card if the Card is proven to be faulty or damaged as a result of the production process or otherwise due to our fault. Any replacement Card will have the same unused value (at the time of replacement) and expiry date. There is a replacement fee of $15 for any Card replacements. Contact us through 1300 079 267 and present your invoice number/claim reference number. The Card will be void if they are defaced, mutilated, altered or tampered with in any way. We may subject Cards to verification and security checks at our absolute discretion. Lost or stolen cards will not be replaced or refunded.

  11. If you have a problem with a purchase made with the Card, or a dispute with a merchant, you must deal directly with the merchant involved. If you cannot resolve the dispute with the merchant, you can contact our Client Services team on 1300 079 267 during business hours or by email to info@giftCardplanet.com.au. To the extent permitted by the law, our liability is limited to replacing faulty Cards.

  12. Any complaints about goods or services purchased with a Card must be resolved directly with the merchant concerned. Any refunds on Card transactions are subject to the policy of the specific merchant. If the Card expires or is revoked before you have spent any funds resulting from a refund (whether or not the original transaction being refunded was made using the Card) then you will have no access to those funds.

  13. We may restrict or stop the use of the Card if suspicious activities are noticed.

  14. You have certain rights under the Australian consumer law which cannot be excluded and are not affected by these Terms. Except for those statutory rights, any conditions implied by any other laws are excluded from these Terms. To the extent permitted by law, we will not be liable to you for any loss or damage (whether direct or consequential), nor be in default under these Terms, for failure to observe or perform any of our obligations under these Terms for any reason or cause which could not, with reasonable diligence, be controlled or prevented. These causes include acts of God, acts of nature, acts or omissions of government or their agencies, strikes or other industrial action, fire, flood, storm, riots, power shortages or failures, sudden and unexpected system failure or disruption by war or sabotage, and other acts or omissions of third parties.

  15. These Terms are to be construed and enforced in accordance with the laws of Victoria, Australia. Any dispute arising from your receipt or use of a Card is exclusively subject to the jurisdiction of the courts of Victoria, Australia (including the Federal Court of Australia, Victoria Registry).
